At a second hearing yesterday, the owner/skipper of the vessel `Incentive’ pleaded guilty to going the wrong way up a traffic lane in the Dover Straits Traffic Separation Scheme.

Folkestone Magistrates fined Mr Stewart Naumann, from Southend in Essex, £500 plus £2,000 in costs for breaching Rule 10(b)(i) of the collision Regulations, in that he did not proceed in the appropriate traffic lane in the general direction of traffic flow for that lane. In passing sentence the Magistrates stated that "this was a very serious offence".

Mr Stewart Naumann was sailing the `Incentive’, a British registered, 55-foot wooden pleasure craft on a voyage from Southampton to Ipswich.

At Dover Coastguard Station, a Coastguard Officer monitoring traffic in the Dover Straits on radar, initially detected the vessel, at 23:25hrs on the 9th September 2000, when the vessel was observed entering the South West lane against the general flow of traffic. Between then and 00:48hrs on the 10th September, the vessel sailed for 14 miles in a north-easterly direction in the south westerly lane, coming into close quarters with 10 vessels. The `Incentive’ then re-entered the south west lane at 02:15hrs and for a further six miles proceeded against the traffic, having close quarters situations with 7 more vessels.

Mr Alan Morgan, Surveyor in Charge Marine Offices South East, stated that:

" This was such a serious breach of the regulations that the MCA had no alternative but to prosecute. It also shows that the owners and skippers of small boats must obey the Collision Regulations and pay particular attention to their navigation when transiting the Dover Straits Traffic Separation Scheme".
